1. Acceptance of Terms
By creating an account or using the Arenova mobile application or website (“Service”), you agree to these Terms of Service (“Terms”). If you do not agree, you may not use the Service.
These Terms are entered into between you and Perriden BV (“Arenova”, “we”, “our”, or “us”).
2. The Service
Arenova is a digital platform that allows fans to log football games they have seen (in stadiums, bars, or on TV), generate insights, and engage with personalized content.
We may update or improve the Service over time. Features may change or be discontinued without prior notice.
3. Eligibility
• You must be at least 13 years old to use the Service. In some jurisdictions, parental consent may be required for users under 16.
• By using the Service, you confirm that you have the legal capacity to enter into this agreement.
4. User Accounts
• You are responsible for maintaining the confidentiality of your account and password.
• You must provide accurate information and keep it updated.
• You are responsible for all activities under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to:
• Use the Service for unlawful purposes.
• Harass, abuse, or harm other users.
• Upload or share content that is offensive, infringing, or illegal.
• Attempt to disrupt or damage the Service, servers, or networks.
6. User-Generated Content (UGC)
• You remain the owner of any content you upload (e.g., notes, photos).
• By uploading, you grant Arenova a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service.
• We may remove or restrict any content at our discretion if it violates these Terms, infringes third-party rights, or is otherwise inappropriate.
7. Intellectual Property
• All rights in the Service, including logos, branding, algorithms, software, and content created by Arenova, remain the property of Perriden BV.
• Aggregated and anonymized data may be used by Arenova for analytics, insights, and reports.
8. Third-Party Services & Ticket Links
The Service may display or provide links to third-party websites, platforms, or services, including but not limited to ticket providers, bars, or clubs.
• No agency or sales role – Arenova is not a ticket seller, reseller, or agent, and does not participate in or process any ticket transactions.
• Direct contract with third parties – Any purchase, booking, or transaction made via a link in Arenova is solely between you and the third-party provider. Their terms and conditions apply.
• No responsibility for third-party content – Arenova is not responsible for the accuracy, availability, pricing, fulfillment, cancellation, or refund of tickets or other third-party offers.
• User responsibility – You are responsible for verifying the legitimacy of third-party providers before completing a transaction.
• No liability – Arenova will not be liable for any losses, damages, or disputes arising from third-party services or ticket purchases.
9. Payments & Fees
Some features of the Service may in the future be subject to fees, subscriptions, or other charges.
• Any applicable fees will be clearly communicated before purchase.
• Unless otherwise stated, payments are non-refundable to the fullest extent permitted by law.
• Additional terms may apply to paid features and will be presented at the time of purchase.
10. Data & Privacy
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal data.
11. Availability & Force Majeure
• We do not guarantee uninterrupted or error-free operation of the Service.
• Arenova may occasionally suspend the Service for maintenance, updates, or technical issues.
• We are not liable for interruptions caused by factors beyond our reasonable control, including force majeure events.
12. Termination
We may suspend or terminate your access if you:
• Violate these Terms,
• Misuse the Service, or
• Engage in fraudulent or harmful activities.
You may stop using the Service at any time by deleting your account.
13. Liability
• The Service is provided on an “as is” and “as available” basis.
• To the fullest extent permitted by law, Arenova disclaims all warranties, express or implied.
• Arenova is not liable for indirect, incidental, or consequential damages arising from use of the Service.
• Our total liability for any claim is limited to €50 or the amount you paid (if any) to use the Service, whichever is greater.
14. Dispute Resolution & Class Actions
• Before initiating legal proceedings, you agree to first attempt to resolve disputes with Arenova through informal negotiation or mediation.
• To the extent permitted by law, you agree not to bring claims as part of a class action, but only on an individual basis.
15. Changes to Terms
We may update these Terms from time to time. If changes are material, we will notify you in the app or on the website. Continued use of the Service after changes means you accept the new Terms.
16. Governing Law and Jurisdiction
These Terms are governed by Belgian law. Any disputes will be subject to the exclusive jurisdiction of the courts of Antwerp, Belgium.
